The band provided this photo via email in April 2005 as a promo photo definitely intended for media like Wikipedia to use. Another detail about this image that I later learned from the group is that it's basically a scan by the band using a page in the liner notes sleeve from the Shadow Dancer album digi-pak, Intercord/EMI European release version. Emailed to me via an email attachment from the band leader. The band leader had provided it as a promotional photo to depict the lineup from 1995 which appeared on the Shadow Dancer album.

The image linked here is claimed to be used under fair use as:

1. it is a historically significant photo of an internationally known band;
2. it is of much lower resolution than the original (copies made from it will be of very inferior quality)
3. the photo is only being used for informational purposes.
4. Its inclusion in the article adds significantly to the article because it shows the subject of this article and how the event depicted was significant; it depicts a lineup in the 1990s that performed on the Shadow Dancer album but which does not tour with the band any more. Falco is no longer based in the United States and has been working throughout the 2000s with European musicians. The lineup depicted includes Jim Sclavunos of Nick Cave's group; Sclavunos also played with Falco in the early 1980s on Panther Burns' Blow Your Top album with Jim Duckworth of the Gun Club and was affiliated for a number of years with the band, as was bassist Kai Eric, also depicted. It is rare to find a photo of this lineup and would be very hard to replace since these musicians have not played with the group in a number of years and there is a different lineup now.
