It is not correct to say that the Treaty of Breda found the Danish crown's right to Orkney and Shetland to be unprescribed and imprescribable. That was a phrase used by the Orkney antiquary David Balfour in 1859.
The annexation of Orkney and Shetland by Charles II in 1669 had nothing to do with the Treaty of Breda, as suggested in an earlier draft. It was simply a withdrawal of privilege from the Morton family.

I cannot find any reference to this claim as being part of the negotiations, apart from the original SOUL website. Happy to put it back but we need a better source.
