Common Law[edit]

I'm not so sure Desuetude is not favoured in common law. IANAL but I know of dozens of laws in Australia (which uses common law) which are on the books and accepted as unenforceable by law enforcement. Just checkout the Queensland "Vagrants Gaming and other Offences Act (1931)" for many classic examples. The entire Act was kept "on the books" because 2 or 3 offences still applied. The rest were widely considered unenforceable by law enforcement and the courts. The Vagrants Gaming and other Offences Act (1931) was repealed only a few months ago. Another example is laws relating to Witch Craft which remained on the books in some common law countries until very recently - but any attempt at enforcement would have seen the matter thrown out of court.
