Acts of the Scotish Parliament[edit]

Are laws made under the Scotland Act 1998 delegated or primary? Morwen - Talk 14:54, 18 Feb 2005 (UTC)

Interesting question; I don't know.... I suppose the statutory instruments made per European Communities Act 1972 are definitely delegated rather than primary. More types of UK legislations are at [1]. – Kaihsu 18:40, 17 January 2006 (UTC)[reply]

I think Acts of the Scottish Parliament are considered primary and Scottish Statutory Instruments secondary. The National Assembly of Wales can only make Statutory Instruments, which are considered secondary. – Kaihsu 16:19, 6 April 2006 (UTC)[reply]

identical to text on another site[edit]

This article is identical to an article found at http://www.answers.com/topic/delegated-legislation. I don't know which came first tough.

Thanks for the warning, but it was Answers.com that has copied from this article. They are fully within their rights to do this as articles on Wikipedia are released under the GNU Free Documentation License. If you take another look at the answers.com article, you will notice a box at the bottom of the page which credits Wikipedia as the source. Just realized something[edit]

I just realized that we have two separate families of articles that need to be crosslinked. It looks like as if delegated legislation is the term used in UK law for what Americans call administrative law. --Coolcaesar 02:39, 18 July 2006 (UTC)[reply]

This is also a crossover with 'statutory instruments' so this article should probably be merged.

Types of delegated legislation?[edit]

As stated in the article "Most delegated legislation is required (by the parent Act) to be made using a Statutory Instrument."
Orders-in-Council, Orders, Regulations, Rules and perhaps some of the other listed types are all made as Statutory Instruments in Great Britain, with Statutory Rules serving the same purpose as Statutory Instruments in Northern Ireland. Some Scottish secondary legislation is published under the banner of "Acts of Sederunt". Road Wizard (talk) 17:24, 22 August 2008 (UTC)[reply]

Possibly. The problem is that "most" of the legislation is released as Statutory Instruments or Statutory Rules. I am not familiar enough with each of the different types to point out the exceptions. (I have removed "Acts of Sederunt" from my earlier comment as they appear to be released under the Scottish Statutory Instrument series.) Road Wizard (talk) 12:44, 23 August 2008 (UTC)[reply]
As Road Wizard says, the difficulty is that it is "most" but not "all". I have copied across from the Statutory Instrument (UK) article a couple of examples with references where delegated legislation is not required to be made by SI. Dmvward (talk) 12:35, 26 August 2008 (UTC)[reply]
