Rationale for Muhammad al-Durrah incident[edit]

Though this image is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:

  1. It is an historically significant and iconic image.
  2. It is of lower resolution than the original. Copies made from it will be of inferior quality.
  3. The image has no monetary value that our use of it would affect.
  4. It has been widely distributed free of charge by the copyright holder.
  5. It is being used for informational purposes in an article about the event it depicts.
  6. The imagery and its historical significance are a key part of the story and the article would be significantly poorer without it.
  7. The significance of this image is that it was the last frame that France 2 broadcast of the shooting sequence, after which they announced that the boy had died, giving the impression that this frame shows his death. In fact, it does not. There was a further, final frame in which he is seen to move his arm, hand, and leg. It was the implication that this frame was the final one that has caused the controversy.
